Client Rights

Record Requests

You have a legal and ethical right to access your health records. To submit a request, please use one of the following methods:

  • Secure Patient Portal (Preferred): Log in and send a secure message. This is the most confidential method for transmitting private records.

  • Written Request: You may email waiter@rickywaiteconsulting.com or mail your request to:

  • Verbal Request: You may make a request in person during a session or over the phone.

What to Include in Your Request

To ensure your request is processed accurately, please provide the following:​

  1. Full Legal Name

  2. Date of Birth.

  3. Specific Records Requested (e.g., "Progress notes from 2024" or "Full record").

  4. Preferred Delivery Method: Please specify if you would like the records sent through the secure portal (most secure), postal mail, or email.

Your Rights

[Texas House Bill 4224 Compliance]

As your clinician, I want you to know that you have a legal and ethical right to request and review your health records. This right is protected under federal law (45 CFR § 164.524/HIPAA) and Texas state law (Texas HB 300 / Health and Safety Code § 181.102), which entitles you to receive a copy of your electronic records within 15 business days. Your health record includes information regarding your diagnosis, treatment plan, and progress notes.

Because these records are written using clinical terminology, reviewing them can sometimes be a complex or emotionally significant experience. My goal is to ensure that your records serve as a helpful tool for your growth; therefore, if you choose to review them, I am available to sit with you to interpret the clinical language and discuss how this information impacts our work together.

Please be aware that in accordance with NASW Code of Ethics Standard 1.08(a), I am ethically obligated to provide you with reasonable access to your records. However, if there is compelling evidence that such access would cause serious misunderstanding or harm to you, I may limit your access to certain portions of the record. In such rare cases, I will provide a written explanation for the denial and, where possible, work with you to review the material in a supportive clinical setting to protect your well-being while upholding your right to self-determination.

Filing a Consumer Complaint with the TX Attorney General (OAG)

Consumers may file a complaint with the Office of the Attorney General Consumer Protection Division. â€‹This office investigates concerns related to consumer protection in Texas.
